Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, waitlist, and digital twin licensing marketplace operated by Skill Bud Technologies Pvt. Ltd. (“Faceyappa”, “we”, “us”).

1. The Waitlist & Eligibility

• You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to join the waitlist or register a face.
• Joining the waitlist is free and grants consideration for early access, but does not guarantee admission to the platform.
• You agree to provide true, accurate, and current information. Submitting fraudulent identities or unauthorized third-party links is strictly prohibited.
• You can withdraw from the waitlist at any time by contacting our support team.

2. Financial Estimates and Guidance

All projections generated by the on-site earnings calculator, example rates, or tier multipliers are illustrative estimates based on public follower counts, engagement benchmarks, and historical industry licensing averages. They do not constitute a binding offer, financial guarantee, or promise of recurring income. Creators set their own minimum floor prices upon onboarding.

3. Escrow and Commercial Payments

Commercial transactions conducted on Faceyappa are backed by a mandatory 100% upfront escrow deposit. Funds remain locked in escrow until the creator reviews and explicitly approves the generated video asset. If a brief is declined or expires after 48 hours without approval, the escrowed amount is refunded automatically to the brand.

4. Prohibited Uses & Safety Redlines

Users and brands are strictly prohibited from using Faceyappa for:

• Generating adult, sexually suggestive, defamatory, hateful, or discriminatory content.
• Creating unauthorized political campaign materials or deceptive synthetic representations.
• Reverse-engineering, scraping, or attempting to download raw AI model weights or voice samples without an active, approved commercial license.
• Circumventing or removing C2PA cryptographic provenance metadata and mandatory “AI Generated” disclosures.

5. Intellectual Property and Personality Rights

Creators retain sole and exclusive ownership of their human likeness, facial features, voice biometric data, and personal brand. Brands receive only the specific, time-limited, non-transferable license tier authorized in writing through the creator's explicit digital sign-off.

6. Modifications and Updates

We reserve the right to modify these Terms to reflect platform enhancements or statutory changes under Indian law, including the Digital Personal Data Protection Act (DPDP), 2023. Continued use of the website or waitlist following any update constitutes acceptance of the revised Terms.
